Terms of Service

These terms are an agreement between you and Quirktastic Inc. (“we”, “us”) about your use of Recess. By making an account you accept them. If you do not, please do not use the app.
Who can use Recess
You must be at least 13 years old. The app asks your date of birth at sign-up and will not create an account below that age. If you are under the age of majority where you live, you need a parent or guardian’s permission.
One account per person. Do not impersonate anyone, and do not make an account on someone else’s behalf without their say-so.
Your account
You sign in with Apple or Google, so there is no Recess password to lose. Keep those accounts secure, because anyone with access to them has access to Recess. Tell us at founders@recesstoday.com if you think someone else is using your account.
What Recess is
Recess is a place to collect small moments through the week and release them to friends on Friday, and to invite those friends to do things in person. It is deliberately quiet between Fridays.
Life Updates release on Friday morning in your own timezone. This happens on its own once you have added something, whether or not you press the button to schedule it. If you do not want an update to go out, delete it before then.
Your content
What you post stays yours. We do not claim ownership of your photos, videos or writing.
To run the service we need your permission to store your content and show it to the people you have chosen: a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it for the purpose of operating Recess, and for no other purpose. We will not use your content to advertise Recess without asking you first. The licence ends when you delete the content, except for copies already distributed to friends and for backups that have not yet aged out.
You are responsible for what you post. Only post things you have the right to post, and be careful posting photographs of other people.
What you may not do
Do not post anything unlawful, or content that sexualises children, or threats, harassment or hate directed at people. Do not post someone’s private information without their consent. Do not spam, scrape, reverse engineer the app, attack the service, or try to reach accounts and data that are not yours. Do not use Recess to organise anything illegal or unsafe.
You can report content and block people from inside the app. We review reports and may remove content or suspend accounts. We will not always get this right, and we will fix it when we get it wrong.
Meeting people in person
Recess helps you plan things in the real world. What happens there is between you and the people you meet. We do not vet users, verify who anyone is, or supervise anything. Use ordinary judgement about meeting people and where you go. We are not responsible for what occurs at a Recess.
Recess Plus
Recess Plus is an optional subscription. It costs $29.99 per year, or $8.99 every three months. Prices are in US dollars and may differ in your local store; the price shown in the app at the moment you subscribe is the one that applies.
You buy through Apple’s App Store or Google Play, and they take the payment. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel in your App Store or Play Store settings; we cannot cancel for you. Refunds are handled by Apple or Google under their own policies.
If we change the price we will tell you before it applies to you, and you can cancel. If your subscription lapses, your account continues on the free tier, and content that a paid feature was displaying stays yours even where it is no longer shown.
Advertising
People without a subscription see a small number of ads. Subscribers do not.
Ending things
You can delete your account at any time from the app. We may suspend or close an account that breaks these terms, or where we are required to. If we close your account and you think we got it wrong, write to founders@recesstoday.com.
The app is provided as it is
Recess is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, and we do not promise the service will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow this, in which case it does not apply to you.
Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before it arose, or USD 50. Nothing here excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud.
Changes
We may change these terms. If a change is significant we will tell you in the app before it takes effect. Continuing to use Recess after that means you accept the new terms.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws rules. Disputes go to the state and federal courts located in Delaware, unless the law where you live gives you the right to bring a claim locally, which it may.
